Ordering Terms & Conditions
These Terms and Conditions apply to all orders placed with Wineaway, whether via our website, telephone, email, or any other means of communication. By placing an order, you agree to the following:
1. Product Availability & Pricing
We make every effort to ensure the accuracy of product descriptions, pricing, and stock availability across all platforms. However, errors may occasionally occur. We reserve the right to correct any such errors and to amend product information, including pricing and availability, without prior notice. Where an error materially affects your order, we will contact you prior to processing.
2. Order Acceptance & Confirmation
Submission of an order does not constitute acceptance of that order. All orders are subject to availability and confirmation. An order is only deemed accepted once it has been dispatched. If we are unable to fulfil part or all of your order (for example, due to stock discrepancies), we will notify you promptly and arrange a suitable resolution, including amendment, substitution, or refund where applicable.
3. Amendments & Cancellations
We reserve the right to cancel or amend any order at our sole discretion, including in cases of pricing inaccuracies, stock errors, or compliance requirements. Where possible, we will contact you prior to making any changes.
4. Liquor Licensing & Queensland Orders
In accordance with our liquor licensing obligations, additional conditions apply to orders delivered to Queensland addresses or collected from our facility where the purchaser is not a Wineaway storage client. A minimum order of either $300 in value or 6 bottles (whichever threshold is met first) is required. If your order does not meet this requirement, we will contact you to arrange a suitable amendment prior to dispatch or collection.
5. PO Box Deliveries
PO Box addresses cannot be entered in the checkout address field. If PO Box delivery is required, please enter your residential address at checkout and include PO Box details in the DELIVERY INSTRUCTIONS. PO Box deliveries are fulfilled via Australia Post and may incur additional charges. Where applicable, we will contact you prior to dispatch to confirm any adjustments.
6. Delivery & Risk
Delivery timeframes are estimates only and may vary depending on location and carrier. We do not control courier or shipping operations and cannot guarantee delivery dates or times. Once an order has been dispatched and handed over to the courier, we are not responsible for delays, loss, or damage that may occur in transit, including unforeseen circumstances beyond our control. Risk in the goods passes to the customer upon dispatch, subject to applicable consumer laws. It is the customer’s responsibility to ensure delivery details are accurate and that a suitable person is available to receive the order.
7. Age Requirement
By placing an order, you confirm that you are of legal drinking age in your country or region. Where delivery or collection is requested, you also confirm that the person receiving or collecting the order is 18 years of age or older (or of legal drinking age in the relevant jurisdiction). Proof of age may be required at the time of delivery or collection. We are legally unable to release alcohol to any person under the legal drinking age. If no eligible adult is available to receive the order, delivery may be refused and the order returned or redelivery arranged at the customer’s expense.
8. Responsible Enjoyment
Wineaway supports the responsible service and enjoyment of alcohol. We reserve the right to refuse service where required to comply with responsible service obligations. Please enjoy wine in moderation.
9. Limitation of Liability
To the extent permitted by law, Wineaway is not liable for any indirect, incidental, or consequential loss arising from the supply or use of our products, including (but not limited to) loss of profit, business interruption, or missed events. Nothing in these Terms affects your rights under the Australian Consumer Law, including in the unlikely event of a product being faulty or incorrectly supplied.
